FCC Waives RHC and E-rate Program Gift Rules Due to Coronavirus Pandemic

On March 18, 2020, the Federal Communications Commission (FCC) issued an order (DA 20-290) that waives the FCC’s gift rules applicable to the Rural Health Care (RHC) and E-rate programs, to assist rural health care providers and schools and libraries affected by the coronavirus disease, also known as COVID-19. This waiver will enable service providers to offer, and RHC and E-rate Program participants to solicit and accept, improved broadband connections or equipment for telehealth or remote learning during the COVID-19 outbreak without running afoul of FCC rules. For detailed information, please refer to the Order.

USAC Remains Open for Business – DC Office Closed

At USAC, we are committed to the health and safety of our employees, contractors, and stakeholders during the COVID-19 pandemic. USAC remains fully operational.

USAC’s Washington, DC office is closed. USAC staff will work remotely and can be reached at their USAC email and telephone numbers. 

While the way we work has changed, USAC will conduct the regular and ongoing work administering the Universal Service Fund. This includes processing and reviewing program applications, collecting contributions, disbursing payments, and implementing program guidance from the FCC. 

All USAC customer support centers remain open. Please be patient if you experience longer than usual wait times with our customer service teams as circumstances continue to change. 

To submit program documents to USAC, please create a case in EPC.

If you send other documents to USAC via mail or overnight delivery, you must also email a PDF copy to Outreach@usac.org.

USAC continues to monitor developments and will implement additional precautions if necessary. This is an evolving situation, and we will keep you informed of any changes.

Application Window Extended Due to COVID-19

The FCC’s Wireline Competition Bureau (Bureau) has directed USAC to extend the deadline for applicants to submit their FY2020 FCC Form 471 applications by an additional 35 days. E-rate applicants will now have until Wednesday, April 29, 2020, at 11:59 p.m. EDT to submit their FY2020 FCC Form 471 applications. The Bureau also directed USAC to provide all applicants with an automatic, 14-day extension for Program Integrity Assurance (PIA) requests. The actions were taken to minimize potential disruptions caused by coronavirus disease 2019 (COVID-19). The public notice announcing the action can be found here.

Kentucky Man Pleads Guilty to Concealing Decade-Long E-Rate Wire Fraud Scheme

Mark J. Whitaker pleaded guilty to misprision of wire fraud. From 2004 until August 13, 2014, Whitaker actively concealed a scheme directed by his co-defendant, Charles “Chuck” Jones, to defraud the federal E-Rate Program. According to the Superseding Indictment, the E-Rate Program allegedly paid Jones and his companies approximately $6.9 million as a result of the fraud. Wire fraud and conspiracy charges against Chuck Jones are still pending. The matter was investigated by the FCC Office of Inspector General and the FBI and prosecuted by the United States Attorney’s Office. DOJ Press Release

FCC Eliminates E-rate Amortization Requirement

On January 27, 2020, the FCC released a Report and Order (FCC 20-3) eliminating the requirement that applicants amortize upfront, non-recurring charges of $500,000 or more over three years, a requirement originally put in place in calendar year 2000.

In 2014, the FCC suspended this requirement through Funding Year 2018. In January 2019, the FCC proposed permanently eliminating the requirement and waived it for the duration of the rulemaking process. Through this Report and Order, it has now been permanently eliminated.

FRN Balance Confirmations Issued Next Week

Each year, USAC undergoes an agreed-upon-procedures (AUP) review. The firm performing the review emails a number of balance verifications (“confirmations”) to applicants and service providers. The purpose of these confirmations is to verify that the balances reported by USAC on specific Funding Request Numbers (FRNs) match the balances in the records of the applicants and service providers.

Next week, the firm reviewing USAC will send confirmations to a number of applicants and service providers. Each confirmation features the balance reported by USAC on a specific FRN as of October 31, 2019.

Applicants and service providers should review their records and respond by either:

• Agreeing with the balance featured on the confirmation or
• If it is different, noting the balance as of October 31, 2019 on their records and explaining how they determined that balance.

The confirmations are being sent from confirmations@us.pwc.com. We ask that you check your email filters for messages from this domain name, and respond promptly to any confirmations you receive.

Funding Year (FY) 2020 Window to Open on January 15, 2020

The FY2020 application filing window will open at noon EST on Wednesday, January 15, 2020 and close at 11:59 p.m. EDT on Wednesday, March 25, 2020.

Winter Deferral Starts Today

Many E-rate Program participants are unavailable during the winter holiday season, and USAC recognizes that participants may need additional time to respond to requests for information.

During our annual winter deferral period, Friday, December 20, 2019 through Friday, January 3, 2020, USAC will only continue reviews of forms and requests where documentation has already been received or participants respond to information requests sent in EPC. 

If USAC does not receive a response during this period, the form or request will be placed in a deferred status until January 3, 2020.

Updating Account Administrators in the E-rate Productivity Center (EPC)

Applicants who intend to update their Account Administrator in EPC must have their current Account Administrator assign this role to someone else. If your current Account Administrator is leaving or changing responsibilities, they can assign those duties to another employee by using the Modify Account Administrator function in EPC.

If your Account Administrator is no longer available, you will need to draft a written request on your entity’s letterhead that includes the information below:

  • Billed Entity Number
  • New Account Administrator’s name
  • New Account Administrator’s job title
  • New Account Administrator’s street address
  • New Account Administrator’s phone number
  • New Account Administrator’s email address. This email address cannot contain a consultant’s name or consultant’s email domain.
  • A brief statement that the current Account Administrator is absent or no longer with the entity.
  • Signature of new Account Administrator.

You must be an employee of the applicant to assume the Account Administrator role. If you have an EPC user account, you can attach this request to an EPC customer service case, or you can call the Client Service Bureau (CSB) at 888-203-8100 for assistance.

CEO of Staten Island technology company indicted for stealing hundreds of thousands of dollars earmarked for internet access at Catholic schools in the Diocese of Brooklyn. The U.S. Department of Justice issued a press release on December 16, 2019 announcing the indictment of John Comito, CEO of AutExec Computer Systems, Inc. for mail and wire fraud in connection with the E-rate Program.

FCC Issues Category Two Budget Report and Order

The FCC has issued a Report and Order (FCC 19-117, released December 3, 2019) to permanently extend the Category Two budget approach with some modifications.

This order extends the Category Two test period through Funding Year (FY) 2020 and provides a prorated portion of Category Two funding, or 20%, to all applicants for the additional year. The order also adopts a modified Category Two budget approach starting with FY2021. It also waives the requirement that the Eligible Services List for FY2020 be released at least 60 days prior to the opening of the FY2020 application filing window.

Updated USAC Website

USAC has launched an updated version of the USAC website. The updated site features design and functionality changes to help users find the information they need, when they need it. The site’s new program homepages put key dates and resources front and center. Information will be updated throughout the year to reflect each program’s lifecycle.

While most of the site’s content hasn’t changed, expanded menus make it easy to navigate to the information you need and improved search
functionality makes it easier to find answers. For example, updated FAQs allow users to search by topic or specific keywords.

The site responds to mobile devices and all operating systems and meets 508 accessibility standards.

With the migration to the updated website, not all USAC URLs will be maintained. This means that any hyperlinks or bookmarks to USAC web content that are not maintained, including PDFs and CSV templates, will redirect users to USAC’s updated landing page, USAC.org, where they can use the improved search functionality to navigate to the content they seek.
